Smart Sites Terms and Conditions
- Authorization. Upon purchase of a website from SmartSiteNow.com, and AIM – Arizona Internet Marketing, LLC, the Client is engaging AIM – Arizona Internet Marketing, LLC (hereby known as AIM), as an independent contractor for the specific project of developing a website.
- The Services. Client is hiring AIM to complete a CMS Small Business website as priced. Standard CMS Small Business website builds include hosting setup, site installation and configuration, navigation configuration, and other processes as needed to get website “live” and online and ready for client content input.
- Web Hosting. AIM will setup and configure hosting on Client’s behalf as part of the website construction (the the actual cost of said hosting is not included in setup price). AIM warrants that a host of good quality will be used.
- Training. AIM agrees to provide client one free 30-minute training session, by phone or in our office, on how to operate site administrative area. Additional training, whether via phone, emails, or in person will be charged current hourly rates.
- Maintenance and Hourly Rate. This agreement does not include updates, site maintenance, or additional training. If the client or an agent other than AIM attempts updating the client’s pages and a problem results from those edits, time to repair web pages will be assessed at the hourly rate.
- Payment of Fees. (a) Project Fees are due and payable in full upon website agreement date. Fees will be charged to Client’s credit card. (b) Hosting fees will be automatically charged each month on Client’s credit card. In the event that a charge may be declined, AIM will attempt to notify Client, and provide Client the opportunity to resubmit payment. In the event that the hosting fee is 30 days delinquent, AIM may opt to remove Client’s site from the web. If after 60 days, Client has still not paid hosting fees, AIM will assume the website is abandoned and Client forfeits rights to all portions of the website.
- Software Updates and Bug Fixes. AIM warrants the website software upon website purchase. Most elements of the website, including the base WordPress software will be able to be updated by the client. Other software, such as third-party plug-ins are not guaranteed regular updates. In the event that a bug or site malfunction occurs as a result of outdated software, AIM will attempt to update that software at no charge to the client. However, AIM cannot guarantee the availability of updates, and cannot guarantee that an update will fix the problem in question.
- Site Outages. AIM does not warrant web pages will be uninterrupted or error-free 100% of the time. Server outages and/or hosting changes that effect site performance will happen. In no event will AIM be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these web pages or website, even if AIM has been advised of the possibility of such damages.
- Copyrights and Trademarks. The client represents to AIM and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other items furnished to AIM for inclusion in web pages are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend AIM and its subcontractors from any claim or suit arising from the use of such elements furnished by the client. AIM represents to the client that all software and items used for Client website are licensed and legal for distribution to the Client.
- License to Web Pages. Upon payment of this contract, the client is assigned rights to use as a website the design, graphics, code and text contained in the finished assembled website.
- Project Completion: Time needed to complete project will be estimated and agreed upon between AIM and Client.
- Sole Agreement. The agreement contained in this Contract constitutes the sole agreement between AIM and the Client regarding this website. Any additional work not specified in this contract must be authorized by a written or emailed change order.
- Information & Product liability. AIM Arizona Internet Marketing, LLC is acting solely in a contractor capacity in construction of this website. AIM does not endorse, promote or warranty any information or products provided on web pages. AIM assumes no liability whatsoever regarding copy information, images, product legality or safety, and assumes neither responsibility nor liability in complaints or litigation arising from these. Client will hold harmless, protect, and defend AIM and its subcontractors from any claim or suit arising from such complaints.
- CANCELLATIONS AND CHANGES. (a) Once the website construction has begun and Client hosting and domain has been set up, Client cannot cancel website purchase for a refund. If client chooses to cancel the project, AIM will do so. However, no funds will be refunded to the client. This is because there will have already been a good amount of work and planning put into the website. (b) If Client wishes to change the scope of the project, Client shall contact AIM in writing or by email with the scope of changes. Any work requested above the agreed upon project may incur additional fees.
- PRIVACY POLICY AND DATA SECURITY. By becoming a customer of SmartSiteNow.com, you have read and understand our privacy and data security policies.
- REFUND POLICY. All sales are final upon initiation of website construction.
- SERVICE AREA. At this time, SmartSiteNow.com will only service customers in the United States and Canada.
- PAYMENT METHODS. We accept Visa, MasterCard, American Express, Discover and PayPal.
